The High Line – a public park on a repurposed railway track in New York City – first opened to the public in 2009, and has been increasingly celebrated as a model public space, and as a democratic project directed by community. Artistic and amateur photographic practices have significantly informed the High Line’s design, landscaping, publicity, urban policy, use and constellations of community. This photo-conceptual essay critically considers the constitutive function of the photographic image, as photography produces, interpellates and defines (...) the public and public sphere of the High Line. However, these imaging practices have also taken increasingly regulated form, and endorse conservative forms of community, personhood and publicness. The new park’s imaging practices may be understood as supplementary to neoliberal forms of property accumulation, in fact diminishing public space even as they purport to represent it. Drawing from the historical avant-garde, feminist critiques of representation and anti-capitalist urban theory, the following photographic series critiques the High Line’s photographic apparatus, from within a practice of photography, and from a position within the field of contemporary art. This essay aims to describe and analyse the important contributions of the Chinese philosopher and diplomat P.C. Chang concerning the 1948 Universal Declaration of Human Rights (the UDHR). After a brief biographical sketch, Chang’s main contributions will be presented and discussed. A study of Chang’s contributions in this context may also highlight the ethical potential of the UDHR and its great relevance to global ethics and world politics today.

Does cross-cultural philosophy stand in need of a hermeneutical expansion? In engaging with this question, the symposium focuses upon methodological issues salient to cross-cultural inquiry. Douglas L. Berger lays out the ground for the debate by arguing for a methodological approach, which is able to rectify the discipline’s colonial legacies and bridge the hermeneutical distance with its objects of study. From their own perspectives, Hans-Georg Moeller, Paul Roth and A. Raghuramaraju analyze whether such a processual and hermeneutically-sensitive approach (...) can indeed open up new hermeneutic horizons. Their responses shed light upon cross-cultural philosophy’s continued embedment in Euroamerican professional philosophy and how the locality of its knowledge-seeking endeavors may indeed have repercussions on attempts to bridge temporal and spatial distances. Aun cuando Trágame tierra2 (1969), de Lizandro Chávez Alfaro (1929-2006), es reconocida como la primera novela contemporánea nicaragüense, sigue ocupando un lugar marginal en el panorama de la crítica latinoamericana. Las lecturas que se le han hecho tienden a enfatizar cómo retrata los esfuerzos revolucionarios contra la dictadura somocista, dando poca importancia al elemento regional que Chávez Alfaro desarrolla, en particular el mundo cultural de la llamada Costa Atlántica. Este artículo analiza la novela a partir de una perspectiva transcultural, guiada (...) por las elaboraciones teóricas de Ángel Rama, con el objetivo de problematizar cómo introduce la otredad cultural del Caribe nicaragüense en el discurso letrado nacional. Se centra en las diversas formas de representar el choque entre la modernización estatal y la diferencia cultural caribeña, en particular las representaciones de sujetos subalternos, la pluralidad de nombres y las tensiones presentadas entre la oralidad y la escritura. Se argumenta que estos elementos forman las piezas de una narrativa transculturadora que destaca la inherente conflictividad de toda simbiosis cultural. (shrink)

Revolutionizing received opinion of Taoism's origins in light of historic new discoveries, Harold D. Roth has uncovered China's oldest mystical text--the original expression of Taoist philosophy--and presents it here with a complete translation and commentary. Over the past twenty-five years, documents recovered from the tombs of China's ancient elite have sparked a revolution in scholarship about early Chinese thought, in particular the origins of Taoist philosophy and religion. In _Original Tao,_ Harold D. Roth exhumes the seminal text of (...) Taoism--_Inward Training (Nei-yeh)_--not from a tomb but from the pages of the _Kuan Tzu,_ a voluminous text on politics and economics in which this mystical tract had been "buried" for centuries. _Inward Training_ is composed of short poetic verses devoted to the practice of breath meditation, and to the insights about the nature of human beings and the form of the cosmos derived from this practice. In its poetic form and tone, the work closely resembles the _Tao-te Ching_; moreover, it clearly evokes Taoism's affinities to other mystical traditions, notably aspects of Hinduism and Buddhism. Roth argues that _Inward Training_ is the foundational text of early Taoism and traces the book to the mid-fourth century B.C. (the late Warring States period in China). These verses contain the oldest surviving expressions of a method for mystical "inner cultivation," which Roth identifies as the basis for all early Taoist texts, including the _Chuang Tzu_ and the world-renowned _Tao-te Ching._ With these historic discoveries, he reveals the possibility of a much deeper continuity between early "philosophical" Taoism and the later Taoist religion than scholars had previously suspected. _Original Tao_ contains an elegant and luminous complete translation of the original text. Roth's comprehensive analysis explains what _Inward Training_ meant to the people who wrote it, how this work came to be "entombed" within the _Kuan Tzu,_ and why the text was largely overlooked after the early Han period. Auschwitz is still the greatest challenge for philosophy and reason, rather than representing their end, as Lyotard most prominently seems to imply. The article shows how the evolution of the question of dialectics from Hegel to postmodernism must be thought in relation to Auschwitz. The critics of reason and Hegel such as Lyotard, Derrida and Foucault are highlighting the break between reason and unspeakable suffering, for which Auschwitz is the most prominent symbol, but reintroduce ‘behind’ the scene much more speculative (...) concepts than Hegel himself (Plasma by Lyotard, khora by Derrida and power as an absolute by Foucault). Adorno for his part thought that only a negative dialectics could address the problem adequately but transferred the unity of opposites just in the realm of utopia. But there is no negative (Adorno) or positive dialectics, only dialectics which mediates and posit the positive and the negative on a higher level. (shrink)

According to the semantic view of scientific theories, theories are classes of models. I show that this view -- if taken seriously as a formal explication -- leads to absurdities. In particular, this view equates theories that are truly distinct, and it distinguishes theories that are truly equivalent. Furthermore, the semantic view lacks the resources to explicate interesting theoretical relations, such as embeddability of one theory into another. The untenability of the semantic view -- as currently formulated -- threatens to (...) undermine scientific structuralism. (shrink)

1947 legt Hans Blumenberg aus Bargteheide in Holstein an der Christian-Albrechts-Universität zu Kiel seine unter schwierigsten persönlichen Umständen entstandene Dissertation 'Beiträge zum Problem der Ursprünglichkeit der mittelalterlich-scholastischen Ontologie" vor. Hinter diesem Titel verbirgt sich eine mit ständigem Bezug auf die Philosophie Heideggers und seine "Fundamentalontologie' geführte Auseinandersetzung mit dem Denken des christlichen Mittelalters, in dem die Frage nach dem Grund des Seins eine so krisenhafte wie produktive Zuspitzung erfahren hatte. Die Dissertation wird von den Gutachtern Ludwig Landgrebe und Rudolf (...) Schneider mit "ausgezeichnet" bewertet, aber sämtliche Bemühungen, zeitnah einen Verlag für die Arbeit zu finden, scheitern. Blumenbergs brillantes Erstlingswerk blieb mehr als 70 Jahre ungedruckt. Nun wird es erstmals publiziert in einer leserorientierten Edition, die unter anderem Übersetzungen der zahlreichen altsprachlichen Zitate wie auch ein "Verzeichnis der Referenzliteratur" bietet, das die Lücke des im Original fehlenden Literaturverzeichnisses schliesst und dieses darüber hinaus durch heute zugängliche Ausgaben ergänzt. In ihrem Nachwort beleuchten die Herausgeber den Entstehungskontext dieses Werks, das überraschende Perspektiven auf Blumenbergs Biographie und Denkentwicklung eröffnet. (shrink)

Oft erscheint sie als eine Welt des alltäglichen Handelns, aus der die Philosophie entspringt, ohne doch in ihr aufgehen zu können. Zum 90. Geburtstag von Hans Blumenberg präsentiert der Suhrkamp Verlag nun einen Nachlaßtext, in dem der Philosoph das Problem weit radikaler faßt. Blumenberg begreift die Lebenswelt nicht als faktische Welt oder Alltagswelt, sondern als die Welt, wie sie wäre, wenn es in ihr keine unbeantworteten (...) Fragen, keine unbefriedigten Bedürfnisse, keine ungesicherten Aussagen gäbe. In dieser Welt der Selbstverständlichkeit ist Philosophie noch nicht möglich oder nicht mehr nötig. Von Kants »Ding an sich± über die Schwarzen Löcher der Astronomen bis hin zum Zustand wunschlosen Glücks reichen Blumenbergs Vergleiche, die auf immer wieder überraschende Weise beleuchten, worin die Schwierigkeiten liegen, die Lebenswelt überhaupt zum Gegenstand von Erkenntnis zu machen. Es zeigt sich, daß die Beziehung zwischen Theorie und Lebenswelt in einer Erfahrung des Verlusts gesucht werden muß: Wissenschaft ist nichts anderes als der Versuch, mit den Folgen des Verschwindens von Selbstverständlichkeit fertig zu werden. Argument quality has consistently been shown to have strong and lasting persuasive effects. The question is what criteria people use to distinguish strong from weak arguments and how these criteria relate to the ones proposed in normative argumentation theory. In an experiment 235 participants without training in argumentation theory rated the acceptance of 30 claims about the desirability of a consequence that were supported by either an argument from analogy, from authority, or from consequences. The supporting arguments were systematically manipulated (...) to violate argument type specific criteria. Participants proved sensitive to the violation of most, but not all, argument type specific criteria. From a normative perspective these findings suggest that people act in a fairly adequate way. These findings also enable a more precise description of what people may do when critically appraising arguments, which has important implications for the use of argument quality as a methodological tool in persuasion research. This essay argues that non-linguistic animals qualify not just for externalist notions of rationality (maximizing biological fitness or utility), but also for internal ones. They can act for reasons in several senses: their behaviour is subject to intentional explanations, they can act in the light of reasons - provided that the latter are conceived as objective facts rather than subjective mental states - and they can deliberate. Finally, even if they could not, it would still be misguided to maintain that (...) animals are capable only of (mechanical) behaviour, not of (intentional) action. (shrink)

This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on presidential dictatorship under (...) Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories. This paper presents the model of ‘bounded revision’ that is based on two-dimensional revision functions taking as arguments pairs consisting of an input sentence and a reference sentence. The key idea is that the input sentence is accepted as far as (and just a little further than) the reference sentence is ‘cotenable’ with it. Bounded revision satisfies the AGM axioms as well as the Same Beliefs Condition (SBC) saying that the set of beliefs accepted after the revision does not depend (...) on the reference sentence (although the posterior belief state does depend on it). Bounded revision satisfies the Darwiche–Pearl (DP) axioms for iterated belief change. If the reference sentence is fixed to be a tautology or a contradiction, two well-known one-dimensional revision operations result. Bounded revision thus naturally fills the space between conservative revision (also known as natural revision) and moderate revision (also known as lexicographic revision). I compare this approach to the two-dimensional model of ‘revision by comparison’ investigated by Fermé and Rott (Artif Intell 157:5–47, 2004 ) that satisfies neither the SBC nor the DP axioms. I conclude that two-dimensional revision operations add substantially to the expressive power of qualitative approaches that do not make use of numbers as measures of degrees of belief. (shrink)

An aspect of Pisistratus, which has not hitherto been utilized in this question , appears to justify another presentment of the evidence which connects him with the Homeric tradition. I shall endeavour to be brief and not to repeat what is common property or irrelevant. The literature and the bearing of the controversy are given with his usual clearness by P. Cauer, Grundfragen der Homerkritik,2 pp. 125 sqq. Cauer's private doctrine, that Homer was for the first time written down by (...) Pisistratus, I consider sufficiently refuted by C. Rothe, Die Was als Dichtung, pp. 5–13. Fantastic views lately promulgated in England are1 dealt with conclusively to my mind by Mr. A. Lang, The World of Homer, pp. 281 sqq., to whose account nothing for controversial purposes need be added. On looking back over the literature I find myself most in agreement with Hans Flach, whose treatise, Die litterarische Thdtigkeit des Peisistratos, 1885, has been unduly depreciated. I shall have to repeat my own views expressed in the Classical Review, 1901, p. 7; 1907, p. 18; and in the Classical Quarterly, 1909, p. 84. (shrink)

Er ist das Wesen, das sich selber immer wieder zum Problem geworden ist und wird, das nicht selbstverständlich einfach so dahinlebt oder -existiert, sondern in gewisser Weise ein reflektierendes Wesen ist, das sich nach sich selber befragt, nach dem Sinn seiner Existenz, seines Lebens, seiner Verfasstheit als eines geschlechtlichen Wesens usw. Das sind Gesichtspunkte, die natürlich immer nur (...) in einer kulturellen und einer traditions-gesellschaftlichen Welt eingenommen bzw. gewonnen werden können. Aufgabe einer philosophischen Anthropologie ist es nun - so Hans Lenk - das Wissen um die Lage und die Fähigkeiten des Menschen in ein Gesamtbild zu bringen. Mit anderen Worten, sie muss sich interdisziplinär verstehen und die Ergebnisse der Wissenschaften, soweit sie für das Thema Mensch und die umfassende Behandlung und Integration aller Aspekte in diesem Zusammenhang wichtig sind, mit einbeziehen.
